Terms of Service

By accessing or using our platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and RealtyTree Inc. (“RealtyTree”, “we”, “us”, or “our”).

RealtyTree provides a link-in-bio platform for realtors and brokerages to showcase property listings, integrate social media, and manage their online presence.

These Terms govern use of realtytr.ee and all associated applications, features, content, APIs, and services (collectively, the “Service”). These Terms apply to all individuals who access the Service, including:

• Subscribers: Real estate professionals and brokerages who create accounts and use the platform to build and manage their online presence (“Subscribers”).
• Visitors: Members of the public who view Subscriber pages, interact with property listings, submit contact or inquiry forms, or otherwise access content published through the Service (“Visitors”).

Together, Subscribers and Visitors are referred to as “Users.” Where a provision applies only to Subscribers or only to Visitors, it is stated explicitly.

We may offer additional services or features that are subject to supplemental terms. By using those services or features, you also agree to those supplemental terms, which are incorporated into these Terms by reference.

Account Registration: Users must create accounts with accurate, complete, and current information to access certain features of the Service. You agree to promptly update your account information to keep it accurate and complete at all times.

Eligibility: You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements. If you are using the Service on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must not share your account credentials with any third party.

Unauthorized Access: You must notify us immediately at support@realtytr.ee if you suspect any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

By using the Service, you represent and warrant that:

• All information you provide is truthful, accurate, and not misleading
• You hold all necessary licenses, certifications, and authorizations required to operate as a real estate professional in your jurisdiction (if applicable)
• Your use of the Service will comply with all applicable federal, provincial, state, and local laws, rules, and regulations
• You will not use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service
• Any property listings you post are accurate, current, and comply with applicable real estate advertising regulations and MLS rules
• You have obtained all necessary consents and permissions to share any personal information or content you upload to the Service

Users agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Use the Service for fraudulent, misleading, or unlawful activities
• Interfere with or disrupt the integrity, security, or performance of the Service or its underlying infrastructure
• Attempt unauthorized access to RealtyTree systems, networks, or data
• Upload malicious software, viruses, worms, Trojan horses, spam, or other harmful content
• Use automated means (bots, scrapers, crawlers, or spiders) to access the Service without our prior written permission
• Engage in any activity that violates fair housing laws, including discriminatory advertising or steering based on race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of any portion of the Service
• Remove, alter, or obscure any proprietary notices, labels, or marks on the Service
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Harvest, collect, or store personal data about other Users without their express consent
• Use the Service to send unsolicited communications in violation of applicable anti-spam legislation, including the Canadian Anti-Spam Legislation (CASL)

We reserve the right to investigate and take appropriate action against anyone who violates these restrictions, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

The following provisions apply specifically to Visitors who access Subscriber pages and content published through the Service.

No Account Required: Visitors may browse Subscriber pages and view property listings without creating an account. By accessing any page hosted on or through the Service, you agree to be bound by these Terms.

Lead Capture & Contact Forms: Subscriber pages may include contact forms, inquiry forms, or other mechanisms for Visitors to submit personal information such as name, email address, and phone number (“Inquiry Data”). By submitting Inquiry Data, you acknowledge that: (a) your information will be shared directly with the relevant Subscriber and may be used by that Subscriber to contact you regarding real estate services; (b) the Subscriber is independently responsible for their use of your Inquiry Data and their compliance with applicable laws, including anti-spam legislation; and (c) RealtyTree may retain Inquiry Data as described in our Privacy Policy.

Data Controller Roles: For Inquiry Data and other personal information submitted through Subscriber pages, both RealtyTree and the Subscriber act as independent data controllers. RealtyTree controls data for the purposes of operating the platform, providing analytics, and maintaining the Service. The Subscriber controls data for the purposes of responding to inquiries and conducting their real estate business. Each party is independently responsible for complying with applicable privacy laws with respect to the data they control.

Analytics & Tracking: RealtyTree may collect usage data from Visitors on Subscriber pages, including page views, interactions, device information, and approximate location derived from IP address, for the purpose of providing analytics to Subscribers and improving the Service. See our Privacy Policy for full details on what data is collected and how it is used.

Cookies on Subscriber Pages: Subscriber pages hosted through the Service may use cookies and similar tracking technologies for functionality, analytics, and performance purposes. By continuing to browse a Subscriber page, you consent to the use of these technologies as described in our Privacy Policy.

No Agency Relationship: RealtyTree is a technology platform provider. RealtyTree is not a real estate brokerage, agent, or advisor. No relationship of agency, employment, partnership, or joint venture exists between RealtyTree and any Visitor. Any real estate transaction or engagement arising from a Subscriber's page is solely between the Visitor and the Subscriber. RealtyTree is not a party to and assumes no liability for any such transaction or engagement.

Listing Accuracy: Property listings displayed on Subscriber pages are provided by Subscribers and third-party data sources (including MLS feeds). RealtyTree does not independently verify the accuracy, completeness, or availability of any listing. Visitors should independently confirm all property details, pricing, and availability with the listing agent or brokerage before making any decisions.

User Content: You retain ownership of any content you upload, submit, or display through the Service (“User Content”). By posting User Content, you grant RealtyTree a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and providing the Service.

Content Responsibility: You are solely responsible for all User Content that you upload, post, or otherwise make available through the Service. You represent and warrant that you own or have the necessary rights, licenses, and permissions to use and authorize us to use your User Content as described in these Terms.

Prohibited Content: Users must not upload content that is unlawful, defamatory, obscene, pornographic, harassing, threatening, invasive of privacy, infringing of intellectual property rights, or otherwise objectionable.

Content Moderation: We reserve the right, but have no obligation, to monitor, review, or remove User Content at our sole discretion, for any reason or no reason, including content that we believe violates these Terms or applicable law.

RealtyTree IP: The Service, including its original content (excluding User Content), features, functionality, design, graphics, logos, and trademarks, is and will remain the exclusive property of RealtyTree and its licensors. The Service is protected by copyright, trademark, and other laws of Canada and foreign countries.

Feedback: If you provide us with any feedback, suggestions, or ideas regarding the Service, you assign to us all rights in such feedback and agree that we may use it without restriction or compensation to you.

RealtyTree respects the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please send a written notice to legal@realtytr.ee containing:

• A description of the copyrighted work you claim has been infringed
• A description of where the allegedly infringing material is located on the Service
• Your contact information (address, phone number, and email)
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
• Your physical or electronic signature

We may remove or disable access to allegedly infringing content and may terminate accounts of repeat infringers at our sole discretion.

Billing: Certain features of the Service require paid subscriptions. By subscribing, you agree to pay all applicable fees as described at the time of purchase. All fees are stated in Canadian dollars unless otherwise specified.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your designated payment method for recurring fees until cancellation.

Refunds: All payments are non-refundable except where required by applicable law. No refunds or credits will be provided for partial subscription periods, downgrade of service, or unused features.

Pricing Changes: RealtyTree reserves the right to modify pricing at any time. We will provide at least 30 days' advance notice of any price increases. Your continued use of the Service after a price change takes effect constitutes your agreement to the new price.

Taxes: You are responsible for all applicable taxes associated with your use of the Service, except for taxes based on RealtyTree's net income. If we are required to collect or pay taxes on your behalf, such taxes will be charged to you.

Failed Payments: If a payment fails, we may suspend or restrict access to paid features until payment is successfully processed. We reserve the right to retry failed charges and to charge applicable late fees or interest to the extent permitted by law.

RealtyTree may offer free trials or promotional pricing at its discretion. At the end of a free trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends. We reserve the right to limit free trial eligibility and to modify or discontinue promotional offers at any time.

User Termination: You may cancel your account at any time through your account settings or by contacting support@realtytr.ee. Cancellation will take effect at the end of your current billing period.

Violation of Terms: We may suspend or terminate your account immediately and without prior notice if you violate these Terms, engage in fraudulent or illegal activity, or if we reasonably believe that your actions may harm RealtyTree, its Users, or third parties.

Effect of Termination: Upon termination: (a) your right to access and use the Service will immediately cease; (b) you remain liable for all fees incurred prior to termination; (c) your User Content may be deleted after a reasonable retention period in accordance with our data retention policies; and (d) provisions of these Terms that by their nature should survive termination will survive, including but not limited to Sections 5, 6, 11, 12, 13, 14, and 15.

Data Export: We recommend that you export any data you wish to retain before cancelling your account. After termination, we are under no obligation to maintain or provide you with copies of your User Content.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy. You also acknowledge and agree that internet transmissions are never completely private or secure.

No Guarantee of Uptime: We strive to maintain Service availability but do not guarantee uninterrupted, timely, secure, or error-free access. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications.

Changes & Updates: RealtyTree reserves the right to modify, update, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Scheduled Maintenance: We may periodically perform scheduled maintenance that may temporarily affect Service availability. We will endeavor to provide advance notice of planned maintenance when practicable.

“As-Is” Service: THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REALTYTREE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

No Real Estate Advice: RealtyTree does not provide real estate, financial, legal, or tax advice. Information provided through the Service, including property listings, market data, and mortgage calculators, is for informational purposes only and should not be relied upon as a substitute for professional advice.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REALTYTREE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT REALTYTREE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.

Maximum Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REALTYTREE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO REALTYTREE IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).

Third-Party Services: We are not liable for the acts or omissions of any third-party services, integrations, or content linked within or accessible through the Service, including but not limited to MLS data providers, payment processors, CRM integrations, and social media platforms.

Essential Purpose: The limitations of liability set forth in this section shall apply even if a limited remedy set forth in these Terms is found to have failed of its essential purpose.

You agree to indemnify, defend, and hold harmless RealtyTree, its officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) your User Content; or (e) your negligence or willful misconduct. RealtyTree reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

Governing Law: These Terms and any disputes arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties for a period of at least thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration administered in Saskatoon, Saskatchewan, in accordance with the arbitration laws of Saskatchewan. The language of arbitration shall be English.

Class Action Waiver: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL.

Injunctive Relief: Notwithstanding the foregoing, RealtyTree may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or other proprietary rights.

RealtyTree shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, civil unrest, government actions, embargoes, labor disputes, strikes, power failures, internet or telecommunications failures, cyberattacks, or any other force majeure event.

By using the Service and providing your email address, you consent to receive electronic communications from us, including but not limited to service announcements, administrative messages, and newsletters. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You may opt out of non-essential communications at any time through your account settings or by following the unsubscribe instructions in any email.

If you access the Service through an API or third-party integration, you agree to: (a) comply with any applicable API documentation and rate limits; (b) not exceed reasonable usage thresholds; (c) not use the API to build a competing product or service; and (d) maintain the security of any API keys or access tokens. We reserve the right to throttle, suspend, or revoke API access at any time for any reason.

Entire Agreement: These Terms, together with the Privacy Policy, Advertising Disclosure, and any supplemental terms, constitute the entire agreement between you and RealtyTree regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver: The failure of RealtyTree to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by RealtyTree.

Assignment: You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. RealtyTree may assign these Terms without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.

Headings: The section headings in these Terms are for convenience only and shall not affect the interpretation of these Terms.

No Agency: Nothing in these Terms shall be construed to create a joint venture, partnership, employment, or agency relationship between you and RealtyTree.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice on the Service at least thirty (30) days before the changes take effect. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
